ZiiTech Pty Ltd (also called “Us” or “We”) in consideration of You using the Our point of sale software in its hospitality business UNDERTAKES TO THE YOU AS FOLLOWS:

  1. We provide point of sale software to the hospitality industry called “Zii”. You are a licensed user of Zii. You acknowledge that the software and your data is hosted in a cloud based storage service operated by a third party under separate license between Us and that third party (“Cloud Host”). You consent to the storage of Your data in, and transfer of Your data into and from, the Cloud Host’s systems.
  2. We will not use, divulge or communicate to any person or entity any of your data entered into the software by You and/or your related bodies corporate (the “Information”) EXCEPT:
    1. with Your prior written consent in writing;
    2. to the Cloud Host but then solely for the purpose of providing the service under our licence agreement with You; and
    3. as required by law and then, subject to giving you available options to object to such disclosure.
  3. We shall not - without your prior written consent - use the Information in whole or in part for any purpose other than for the provision of software and related services and shall not use or suffer to be used the Information in a manner detrimental to You. However, we may anonymize any customer data and analyse it for the purpose of product development and improvement.
  4. The obligations contained in this confidentiality undertaking shall continue to apply for a period of three (3) years after the date of this undertaking, but shall cease to apply to information or knowledge which may come into the public domain other than directly or indirectly through unauthorised disclosure made or given in breach of this undertaking.
  5. On Your request, We shall destroy or deliver to You, without retaining copies thereof, all Information identifiable as Yours, acquired for or generated during the provision of the service or use of the software.

“We” and “Us” and “Our” means ZIITECH PTY LTD ABN 46 635 021 779 of Tenancy C, Level 3, 990 Whitehorse Road, Box Hill, Victoria 3128.
